Super Visa

Super Visa is designed for Parents and Grandparents to visit their children/grandchildren for longer time periods. It is a multiple entry visa and lets you visit for 5 years at a time. Unlike other visitor visas, Super visa has specific requirements such as mandatory medical insurance.

Eligibility

To apply for Super Visa, you must

  • Be a parent or Grandparent of a Canadian citizen or Permanent Resident
  • Apply from outside Canada and not be inadmissible
  • Have a signed letter from your Child or Grandchild that includes promise of financial support for entire length of the visit, number of people in sponsor’s household and a copy of sponsor’s Canadian citizenship or Permanent Residence.
  • Have proof of medical insurance from a Canadian company or an insurance company outside Canada approved by IRCC.
  • Insurance must have a minimum of 100000 CAD coverage and valid for at least a year from the date of entry.
  • Provide proof that Insurance premium has been paid in full or in instalments with an upfront deposit.

Financial Support

The person inviting you must demonstrate that their household meets the MNI (Minimum Necessary Income). Provided below is a list of documents that can be used as proof of funds

  • NOA or T4/T1 for the most recent tax year.
  • EI benefits statements.
  • Employment letter outlining job title, hiring date, job description and salary.
  • Bank Statements.

Atlantic Immigration Pilot Program

The Atlantic Immigration Pilot is a fast-track employer driven immigration program that allows employers in Canada’s four Atlantic provinces — Nova Scotia, New Brunswick, Newfoundland and Labrador and Prince Edward Island — to hire skilled foreign nationals and international graduates for jobs they have not been able to fill locally. For candidates to qualify under this immigration program, their employer should be on the designated employers list.

AIPP was launched originally as a pilot program. Taking AIP’s success into consideration, the government has committed to making this pilot a permanent program.

The Atlantic Immigration Pilot is designed to welcome additional newcomers to the Atlantic Canada region to fill the needs of local employers and communities.

The three-year pilot program allows designated local employers to identify, recruit and retain global talent. The program also has the goals of supporting population growth, developing a skilled workforce, and increasing employment rates in the region.

The pilot program forms part of an overall Atlantic Growth Strategy that is focused on the following five priority areas:

  • skilled workforce and immigration.
  • innovation
  • clean growth and climate change
  • trade and investment
  • investment

How does It work?

The Atlantic Immigration Pilot is an employer-driven program that facilitates the hiring of foreign workers. All principal applicants arriving in Canada under the pilot program must have a job offer from a designated employer and an individualized settlement plan for themselves and their family.

Once a designated employer finds a candidate who meets their employment needs and the program criteria, that employer will need to first offer them a job. Employers do not need to go through the process of obtaining a Labour Market Impact Assessment (LMIA) under this program.

Once the candidate has accepted the job, the employer will connect the candidate with a designated settlement service provider organization for a needs assessment and to develop a settlement plan. Employers will also support the long-term integration of the new immigrant and his or her family, if applicable, so they can reach the goals of their settlement plan once they arrive in Canada.

Employers that need to fill a job vacancy quickly will have access to a temporary work permit, so that the candidate and his or her family can come to Canada as soon as possible. In order to obtain this work permit, candidates will need:

  • a valid job offer.
  • a letter from the province; and
  • a commitment to apply for permanent residence within 90 days of the temporary work permit application.

Provincial Nominee Program (PNP)

Canada has bilateral agreements with provinces and territories (excluding Nunavut and Quebec) which allows them to nominate individuals for permanent residence. Quebec and Nunavut have their own selection system in place. In this process, the provinces normally assess a particular nominees’ capability to contribute to economic growth, development and prosperity of their particular province. Canadian laws enable these provinces and territories to set out their own criteria for nomination as long as they are in line with IRPA, IRPR, Federal immigration policy and the federal – provincial agreements.

Nowadays, PNPs offer two different pathways. You can go through regular PNP streams or You can take the express entry stream routes, if eligible. If you are nominated by a province through an EE stream, you get 600 points in your express entry profile which guarantees you an ITA under the existing circumstances.

Family Sponsorship

If you are a Permanent Resident or a Canadian citizen aged 18 or over, you can sponsor certain family members to immigrate permanently to Canada. If you successfully sponsor them for permanent residence, you are financially responsible for them for a certain period of time, also known as the duration of the undertaking. You must also ensure that they do not need social assistance from the government. One of the objectives of Immigration and Refugee Protection is to see that families are reunited in Canada. In line with this objective, Family reunification is among the top priorities for the Canadian government.

There is a wide range of options under the Family class. You can sponsor your Spouse, Common Law Partner, Conjugal Partner, Dependent Children, Parents and Grandparents to become Permanent Residents of Canada. Under some specific circumstances, you can sponsor some other relatives.

Sponsoring your Spouse, CLP, Conjugal Partner and Dependent Children

An eligible Canadian Citizen or Permanent Resident can sponsor their spouse, CLP, conjugal partner or their dependent children. To be eligible under this category, an applicant must meet certain requirements some of which are listed below. An applicant must:

  • Be at least 18 years of age.
  • Not be inadmissible.
  • The relationship must be genuine. If the relationship is not genuine, your application may be rejected.

When it comes to dependent children, you can sponsor your own dependent children or dependent children of your partner. Some other conditions for dependent children to qualify are as follows:

  • Must be under 22 years of age. Children over 22 years of age qualify as dependent children if they are unable to support themselves because of a mental or physical condition and they have depended on their parents for financial support since before the age of 22.
  • Must not have a spouse or CLP.

Sponsoring Parents or Grandparents

In order to sponsor your Parents or Grandparents, you must first submit an interest to sponsor form. The relationship can be by blood or adoption. You can sponsor more than one person or couple provided you meet the income requirements. The applicants must not be inadmissible and willing to get their medicals done. You cannot sponsor your in laws but can co sign your spouse’s application for sponsoring his/her parents or grandparents.

Invitations to apply for 2023 will be sent out between Oct 10 -Oct 23, 2023. Interest to sponsor forms may open in the future.

Sponsoring other relatives

You can sponsor an orphaned brother, sister, nephew, niece or grandchild if they meet all the following conditions:

  • They are related to you by blood or adoption.
  • Both their mother and father are not alive.
  • They are single.
  • They are less than 18 years of age.

You may sponsor one relative of any age related by blood or adoption if you meet al the following conditions:

  • You do not have a living relative you could sponsor such as a spouse, CLP, conjugal partner, children, parent, grandparent, orphaned brother/sister, orphaned nephew/niece, orphaned grandchild.
  • You do not have any relatives listed above who is a Canadian citizen or PR or registered Indian under the Indian act.

Citizenship

Eligibility

There are certain conditions that you need to meet before you can apply for Canadian citizenship. You must:

  • Be a permanent resident.
  • Have filed your taxes if required.
  • Prove your language proficiency.
  • Have lived in Canada for 3 out of the preceding 5 years (must be physically present in Canada for a minimum of 1095 days out of 1826 days from the date you sign your citizenship application).

Work Permit Extension

If a Temporary Foreign Worker (TFW)’s work permit is about to expire, they can apply to extend it under different circumstances for different types of work permits. The extension must be applied at least 30 days before the expiry of their current work permit.

Employer Specific Work Permits

You can apply to extend or change conditions on this type of work permit when:

  • Your job is extended.
  • There are changes such as pay raise, increased job duties etc.
  • You want to change your employer.
  • There is a different job offered to you.

Open Work Permits

If you are on an open work permit, you can always apply to extend it as long as you are still eligible to work in Canada with an open work permit.

Bridging Open Work Permit

Bridging open work permit (BOWP) is an option available to some permanent residence applicants. The most basic eligibility criteria for BOWP is that you should already be working in Canada on a valid work permit. Employer Specific Work Permit

An employer-specific work permit (also called a closed work permit) allows foreign nationals to work for a specific employer for a designated period of time. This work permit lists certain conditions such as the name of the employer, the length of time you can work for, and the location of work, if applicable.

Eligibility

There are specific requirements that need to be met in order to apply for work permit depending on the area where you are applying from. You must:

  • Have no criminal record and be willing to get a Police clearance certificate.
  • Not be a danger to Canada’s security.
  • Be in good health and have a medical exam if needed.
  • Be financially self sufficient for your and your family members stay in Canada.
  • Prove that you will leave Canada at the end of your work permit.
  • Not plan to work for an “ineligible” employer.
  • Not plan to work for an employer offering erotic dance, striptease, escort services or erotic massages.

Open Work Permit

Open work permit allows an applicant to work for any employer across Canada except those employers who are listed as ineligible or who offer erotic dance, striptease, escort services or erotic massages. Some circumstances under which you can apply for an Open Work Permit are as follows:

  • You are an international student who has graduated from an eligible DLI and is eligible for PGWP.
  • You are spouse or CLP of an international student or skilled worker.
  • You are the spouse or CLP of an applicant of the Atlantic Immigration Pilot program.
  • You are a refugee, refugee claimant, protected person, or a family member.
  • Prove that you will leave Canada at the end of your work permit.
  • You are under an unenforceable removal order
  • You are a TRP (Temporary Resident Permit) holder.
  • You are a young worker participating in special programs.

You must also meet general additional criteria to be eligible to apply for an Open Work Permit.

Visitor Visa Extension

A foreign national’s stay as a visitor in Canada is 6 months by default but this can vary as per the discretion of their respective immigration officer dealing with them at the Port of Entry (POE). If you want to extend your stay in Canada, you need to apply to extend your stay at IRCC. If approved, you are not issued a new visa but a document called visitor record.

A visitor record gives you status as a visitor and has a new expiry date. However, you must apply for visitor record at least 30 days before your current status expires. Also, A visitor record does not authorize re-entry to Canada.

Eligibility

Some basic requirements need to be met before IRCC grants an applicant a visitor visa. An applicant must:

  • Be in good health.
  • Have a valid passport or other travel document.
  • Have no adverse record such as a criminal conviction or immigration-related conviction.
  • Have strong home ties.
  • Convince an immigration officer that the applicant will leave Canada at the end of their stay.
  • Be financially self-sufficient to pay for the applicant and their dependent’s stay in Canada.

In some cases, an applicant may need a medical exam and a letter of invitation from someone who lives in Canada.

Electronic Travel Authorization:

Residents of some select nations do not need a TRV to enter Canada. Instead, they might need to get an eTA, also known as Electronic Travel Authorization. An eTA is an entry requirement for visa-exempt foreign nationals who intend to travel to Canada by air and is electronically linked to the traveler’s passport. An eTA is usually valid for five years but can expire earlier in conjunction with the expiry of your passport.

Applying for an eTA is a simple online process that takes little time to complete and is usually approved within a few minutes as per the IRCC website. However, in some cases, it may take days to process if additional documents are required.  The application fee for an eTA is $7 CAD.
